Menendez brothers to find out if they will be resentenced

The Menendez brothers, who were convicted of murder for killing their parents in Beverly Hills in 1989, will find out today if their resentencing hearing will go ahead.

Lyle Menendez, 56, and his brother Erick, 53, are currently serving life in prison without parole.

Aged just 21 and 18 at the time they fatally shot their parents in the family home, the brothers long argued that they were physically, emotionally and sexually abused as children, prompting the killings.

They say they feared their parents would kill them, to cover up the abuse.

With this defence, the first trial ended in a hung jury in 1994, before a second jury found them guilty in 1995, rejecting a death sentence for life without parole.

Lawyers have since argued that due to society's changing views on sexual abuse, they should have instead been charged with manslaughter - something which was not given as an option during the second trial.

Their story has gathered increased attention over the years due to television dramas and documentaries on the case going viral.

The hearing comes after multiple delays, most recently due to a change in District Attorney.

The previous District Attorney, George Gascon had scheduled a motion for the resentencing of the brothers on March 20.

However, it was pushed back after an attempt by the new District Attorney, Nathan Hochman to withdraw the resentencing motion, claiming their story of self-defence was a lie.

Friday's hearing will determine if the resentencing petition proposed by Mr Gascon will be upheld or withdrawn.

Depending on what the court decides, resentencing for the brothers could take place sometime next week.
